Online Ticket Sale Terms & Conditions

§ 1 General Terms
1. Present Online Ticket Sale Terms & Conditions governs online ticket sale conducted via the website festival.soundrive.pl .
2. Present Terms and Conditions are exclusively subjected to Polish law regulations.
3. In these Terms and Conditions, the following words and phrases shall have the following meaning:

1. “Website” means the online ticket sale system conducted via the website festival.soundrive.pl on which the Promoter makes Tickets available using distance communication methods, without the simultaneous presence of both parties.
2. “Promoter” means Sopocka Odessa Ewa Hronowska, the Boh. Monte Cassino 54 street, 81 759 Sopot, IN VAT 585 133 63 52, ID 810475070, signed in commercial record of Sopot. It is the owner of the Website.
3. “Booking Party” means a natural or legal person (including a Consumer) or other entity that has legal capacity, purchasing Tickets via the Website.
4. “Consumer”means a natural person of who purchases a Ticket via the Website for the purpose not related to his/her occupation or business activity.
5. “Ticket” means a document in the digital or paper form, entitling persons to take part in Events held in the time and venue determined by the Promoter.
6. “Event” means an event organized by the Promoter (particularly concerts, recitals). Only persons of 18 and above possessing valid Tickets have rights to admission for the Event.
7. “Booking” means a procedure followed in order to conclude a Contract to purchase a Ticket, preceded by selection a type of Tickets, a method of payment and receipt.
8. “Contract” means a contract, which is concluded between the Promoter and the Booking Party.
9. “Data” mean details regarding the Booking Party, including personal details processed in order to complete Booking execution.
10. “Price” means a unit price of a Ticket featured in the Ticket`s description, given in the Polish currency. The Price is VAT inclusive and does not include a Delivery Charge.
11. “Delivery Charge” means a charge for making a Ticket delivery to a Booking Party, which is to be covered by the Booking Party.
12. “Payment” means the payment for a Ticket, in the manner selected by the Booking Party while made a Booking, including a Price and a Delivery Charge.

4. A user acknowledges the fact that the Ticket sale online is conducted by the agency of the ICT system. In order to purchase a Ticket, the Booking Party should have a computer or any other device equipped with software enabling access to internet.
5. The Booking Party shall acquaint with these Terms & Conditions before purchasing a Ticket.
6. Content contained within the Website is the sole property of the Promoter and is legally protected.

§ 2 Tickets and Bookings

1. The Booking Party may make Bookings every single day throughout 24 hours.

2. Prior to submitting a Booking, the Booking Party should select the Event, a type and number of Tickets, delivery and payment methods.
3. In order to execute a Booking, the Booking Party is required to provide its personal data, particularly:
a) Name and Surname
b) Phone number
c) E-mail address
4. In the event that the Booking Party selected post service as a delivery method, the Booking Party is required to provide a point of delivery.
5. Personal data is made available by the Booking Party on a voluntary basis, but it is necessary to complete a Booking.
6. The Booking Party confirms its Booking by ticking “Order” in a box.
7. The Booking Party is to receive its Ticket, once a Payment has been made.
8. Once a Booking has been submitted, the Promoter will e-mail the Booking Party a confirmation of submission of the Booking.
9. In the event that a Payment has not been made within 24 hours since the Booking Party received its confirmation, the Promoter is authorized to cancel the Booking.
10. Depending on the selection made by the Booking Party, a Ticket may be delivered as:
a. A paper document, printed out by the Promoter and delivered to the Booking Party by the agency of the Polish Post.
b. A digital document – a PDF file sent to an e-mail address supplied by the Booking Party. The Booking Party is to print out the Ticket by itself.
c. A digital document – a bar code sent to the Booking Party`s mobile device.
11. The Promoter reserves the right to cancel or reschedule Events for plausible reasons. In such case, a purchased Ticket will be accepted as valid in a new date set by the Promoter.
12. If the Event is cancelled or rescheduled, the Promoter will inform all interested parties on the Website and will sent notification that will include a new date, to the Booking Party`s e-mail address.
13. A purchased Ticket will not revert, except for § 2 sec.14 below.
14. If an Event is cancelled, the Booking Party has right to return its Ticket and to claim a refund.

§ 3 Payment and Delivery

1. A Payment should be made before the Booking execution or at its receipt.
2. The Promoter accepts payments made by the agency of Dotpay.pl system and accepts following payment methods:
1) Banker`s draft
2) Credit card
3. In the event that the Payment is made as abovementioned in § 2 sec.2, the Booking Party is redirected to a calculating web application, which enables to complete a transaction using a communication network.
4. The Payment is considered to be made on the day, when the Payment is being credited to the Promoter`s account.
5. A Delivery Charge will vary depending on selected Ticket specification (e.g. a paper form, a sort of delivery service).
6. The Promoter will issue a VAT invoice at the Booking Party`s request.
7. A Ticket will be delivered to an e-mail address or other address provided in a Booking.
8. A Ticket in the form of a paper document will be delivered by the agency of delivery companies or the Polish Post. The Promoter determines foreign countries, to which a Ticket delivery is feasible.
9. It is obligation of the Booking Party to check on receipt of a Ticket, whether the Ticket is not damaged and complies with a Booking. If the Ticket complies with the Booking, the Booking Party confirms its receipt by its signature.
10. In the event that the Booking Party notices any damages, incompleteness of a parcel or other faults, the Booking Party has right to make a complaint as mentioned below in § 4 of these Terms and Conditions.

§ 4 Complaints
1. In the event that a delivered Ticket does not comply with provisions of a Contract, the Booking Party has right to make a complaint.
2. A complaint should be made accurate and determine the claim limits.
3. The Promoter will respond to a complaint within 14 days since its receipt.
4. In the event that a complaint is incomplete or inaccurate, the Promoter will request the Booking Party to supplement its complaint.
5. In the event that the Promoter does not respond to a complaint within 14 days since its submission, the complaint may be considered as accepted.
6. The Booking Party will be informed about a result of a complaint procedure via e-mail.

§ 5 Responsibility
1. The Promoter assumes no responsibility for any loss, incurred by the Booking Party, caused by its unprotected electronic device providing connection with Internet.
2. The Promoter assumes no responsibility for course and effectiveness of transactions conducted by the agency of calculating web application service.

§ 6 Personal Data
1. The Promoter i.e. Sopocka Odessa Ewa Hronowska, the Boh. Monte Cassino 54 street, 81 759 Sopot administers and processes the Booking Parties` personal data in order to execute a Booking or – in the event that complaints have arisen – to respond to a complaint.
2. Depending on the Booking Party`s consent, its personal data may be processed for marketing purposes including transmission of commercial information by electronic means.
3. Personal data is made available by the Booking Party on a voluntary basis, but it is necessary to complete a Booking.
4. The Booking Party has right to access and rectify its personal data.

§ 7 Final Provisions
1. Present Terms and Conditions are available at festival.sounrive.pl in the digital form enabling their downloading and recording by electronic means used by the Booking Party.
2. The Promoter reserves the right to modify these Terms and Conditions. Any modifications shall take effect 14 days after posting on the Website. Modifications do not affect Bookings submitted before that date.
3. If any provision of any of these terms and conditions on the Website is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the validity and enforceability of the remaining provisions of the terms and conditions shall not be affected.
4. Any dispute arising out of or in connection with the Terms & Conditions shall be subject to the jurisdiction of the Polish Court in accordance with Polish law.
5. With regard to issues not regulated by these Terms and Conditions, regulations of the Polish law, and particularly the provisions of the Civil Code, are applicable.
